These terms apply when you use ED-ChatBot, including the WordPress plugin, ChatBot Cloud and the Inbox app (the “Service”), provided by Express Design Agency, Cape Town, South Africa (“we”, “us”). By creating an account, installing the plugin or paying for a plan, you agree to these terms.
1. Your account
You must give accurate details and keep your password safe. You are responsible for everything done in your account, including by team members you invite. You must be 18 or older and able to enter a contract for your business.
2. Plans, trial and payment
- The Free plan includes 50 chats a month and answers from your knowledge base.
- Starter and Pro are monthly subscriptions. New accounts get a 7-day Starter trial without a card. If you do not subscribe, the account moves to the Free plan when the trial ends.
- Payments are processed by Paystack and charged in the currency shown at checkout (South African rand unless stated otherwise). Prices shown in other currencies on our website are approximate guides.
- Subscriptions renew automatically each month until you cancel. You can cancel at any time in Plan & billing; you keep your plan until the end of the period you paid for. We do not refund partial months unless the law requires it.
- We may change prices with at least 30 days’ notice by email. The new price applies from your next renewal after the notice period.
- If a payment fails, we may move the account to the Free plan after a short grace period.
3. Your content and your visitors
You own the content you add (knowledge base, replies, settings) and the information your visitors share. You give us permission to store and process it only to provide the Service. You are responsible for:
- having a lawful basis and a privacy policy for collecting your visitors’ information, as POPIA and other laws require;
- making sure your knowledge base is accurate, including prices, hours and policies;
- honouring bookings made through your chatbot, and the sales made through your shop.
4. AI answers
The chatbot answers from the information you provide and, when AI is switched on, uses third-party AI models. AI can make mistakes. Do not use the Service to give medical, legal or financial advice, or for decisions that need a qualified person. Check important answers and keep your knowledge base up to date.
5. Acceptable use
Do not use the Service for anything illegal, for spam, to collect passwords, card numbers or ID numbers through the chat, to harass people, or to try to break, overload or copy the Service. We may suspend accounts that put other customers or the Service at risk.
6. Bookings and online shop features
Booking and shop features help your customers book and add products to their cart. Payments for your products happen on your own checkout (for example WooCommerce or Shopify), and the contract for those bookings and sales is between you and your customer.
7. Availability and changes
We work to keep the Service available and backed up, but we cannot promise it will never be interrupted. We may improve or change features; if we remove a major paid feature, we will tell you in advance.
8. Liability
To the extent the law allows, the Service is provided “as is”, and our total liability for any claim is limited to the amount you paid us in the 3 months before the claim. We are not liable for indirect losses such as lost profits or lost data. Nothing in these terms limits rights you have under the Consumer Protection Act where it applies.
9. Closing your account
You can close your account at any time by contacting us. We may close accounts that break these terms. After closing, you can ask for an export of your content within 30 days; we then delete it as described in our Privacy Policy.
10. Law and contact
These terms are governed by the laws of South Africa. Questions: admin@expressdesignagency.com.
